US Judge Orders Release of Abrego Garcia from Immigration Detention

A court has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment is without lawful basis.

"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.

The situation stems from a mistaken deportation to El Salvador in March, which US authorities later admitted was an error. Following his return to the United States to face alien smuggling charges, he was detained in federal detention.

In her order, the court pointed out that the authorities does not have a current removal order, which prevents them from removing Mr. Abrego Garcia "at this time."

The legal proceedings involve disputed assertions. Whereas the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this allegation.
